I would imagine that they also evaluate the living-arrangement, to ensure that no minors are present in the household.

HONOLULU -- Rep. Galen Fox announced Monday he is resigning from office effective Dec. 1. KITV learned Fox was convicted in California of a sex charge for fondling a woman on an airplane.

"I vigorously fought the charges against me, which I hold to be untrue. I lost. I believe the people of Waikiki, Ala Moana, and Kakaako deserve to be represented by someone unclouded by a conviction such as the one I now carry," Fox said in a statement to reporters Monday afternoon.

The incident happened on a United Airlines flight from Honolulu to Los Angeles on Dec. 18, 2004.

The 27-year-old victim said Fox placed his hand in her lap and rubbed her crotch while she slept in the seat next to him. She had her lap covered with a blanket at the time, according to FBI officials.

A judge convicted Fox of a misdemeanor in federal court in Los Angeles on Oct. 20.

"We took it to trial, I strongly fought the case with everything I could and lost," Fox said.

Fox left the news conference without explaining what he had been charged with.

Fox is well liked at the Capitol, soft spoken and thoughtful, which made the case even more shocking.

The woman immediately challenged Fox and talked to the flight crew. Fox had unzipped her pants, prosecutors said. Fox denied unzipping the woman's jeans.

In the complaint, Fox admitted to reaching over to touch the victim. He also stated that he should not have been touching her.

"She said things about what I did that were just absolutely untrue. And I said what I thought had happened and the judge ruled in her favor," Fox said.

Fox's sentencing is scheduled for January. The prosecutors said they will not ask for jail time.

"Do you have a problem?" KITV reporter Daryl Huff asked Fox.

"I do not believe that I have a problem. I will obviously have to do whatever the court decrees," Fox said.

Fox also faces the likely possibility that he will have to register as a sex offender. His face and address would be listed on the Internet.

"I'm saddened by this situation and feel badly for Rep. Galen Fox and all the parties involved. Rep. Fox has been a dedicated public servant, and it is unfortunate that this has happened. By resigning today, he has done what is in the best interest of his constituents and the legislative process," Gov. Linda Lingle said.
