well i got blindsided on the day of court. I thought we were going in to court, and we ended up settling right outside of court on his counsel. He then left the firm or got fired, it's unclear. Anyhow, fastforward to now, and she's got the house, but I'm still on the mortgage. The only way off is for her to refi or sell. I can't force her to do either of those things. Now that she gave up her salaried job to wait tables and shack up with a waiter and pop out a kid, I don't think she'll qualify for a refi.

Wondering where to go or who to lash out at.

I would consult a lawyer of lawyer friend for that advice. Going against a law firm for malpractice would be crazy I would think, but going after the "settlement" might work.

i co-signed onto $14K worth of student loans with my ex before our split. we mediated an agreement where i would refi the house under just my name, and she would get the loans back under hers. i did my duty and refi'd the house within 6 mos of the divorce, yet five years later i'm curiously still on the student loans. which have ballooned up to $21K due to interest, because she keeps deferring payback. and i've been pinged at least a few times by SallieMae collections for her delinquency for accidentally letting the loans go live. not sure how this will end up, but i've considered saving up an emergency fund for it.

Lord willing I'll never have to go through something like this--but I have far too many friends who have had to deal with similar situations. Be it with kids and how much they pay weekly/monthly to what you mention about houses. Its a cutthroat business it seems.

One friend just had his ex decide to pursue added financials, he now has to take on a second job. Its incredible.

Sorry to hear this Phil. My cousin is going through something similar.

His crazy wife got mad because my cousin wasn't making enough money she felt was needed to give their 2 kids everything she wanted to give them. She wanted him to quit the job he had (that he loved, working with horses) and get something that made more money. It became a major issue. Long story short, she cheated on HIM, they got divorced, she got the kids AND the house. He got visitation on weekends.

Now, she's taking him back to court because they live 2 hours away from each other and she wants them to stay closer to home instead of spending time with their dad.

It's fucking awful. Sadly, no matter how good of a father, person, he is, the courts favor the mother most of the time.

Not sure if he's still on the mortgage. She's already remarried too. BLECH. Always disliked her. Total frump girl.

Lawyers don't like suing other lawyers in my experience. Honor among thieves and all that.

every state bar association has lawyers that enjoy investigating bar complaints, however.

Yeah man, Bar Complaint may be the best place to start.

In reality to get this fixed I'm pretty sure you'll need a new lawyer and a judge willing to look at the agreement.
