FCC Rules May Force Indie 103.1 FM to Change Its Tune

Clear Channel is ending the joint sales agreement with Entravision since it has one more station than is allowed.

February 24, 2005

The future of Indie 103.1 FM, hailed by Rolling Stone magazine as "America's coolest commercial station," may be in jeopardy because a shift in federal regulations will force Clear Channel Communications Inc. to abandon its business partnership with the station's owner.

Indie 103.1 is owned by Entravision Communications Corp., a Santa Monica-based Spanish-language media company. But it went on the air 14 months ago under a so-called joint sales agreement with Clear Channel, the largest radio station operator in the U.S. and the owner of eight stations in the L.A. market.

Revised Federal Communications Commission regulations redefine joint sales agreements in such a way that Indie 103.1 constitutes Clear Channel's ninth station here, and federal media rules bar any company from owning more than eight.

Roy Laughlin, Clear Channel's regional vice president in Los Angeles, said the company would walk away from the partnership April 1.

"Our lawyers have told us that we have to do this," Laughlin said. "The audience and advertisers will see no disruption, that is my hope."

He called Indie 103.1 "a great success story." With rock star DJs such as Steve Jones, formerly of the Sex Pistols, the station's unusual playlist finds room for the Clash, Franz Ferdinand and Frank Sinatra.

It's unclear whether Entravision will continue the format without the business benefits of the arrangement with Clear Channel, which used its clout to line up advertisers for the station.

Entravision executives declined to comment.

Jeff Pollack, a radio consultant, said the industry chatter was that programming on Indie 103.1 would probably be rejiggered and geared toward one of the L.A. area's myriad ethnic communities. But there has been speculation that the station's bond with a valuable listener niche might make it a natural to move to satellite.

"No matter what, it's going to be hard for the station to continue as it is," Pollack said. "It certainly has its fans and an intriguing music mix, but the ratings have just not been there."

Under the joint sales agreement, Clear Channel's advertising staff sold time on Indie 103.1 at rates lower than those offered by the region's dominant rock powerhouse, KROQ-FM (106.7), which is owned by Infinity Broadcasting Corp.

Clear Channel's salespeople also pitched ad time in bundled deals with its other stations, such as KIIS-FM (102.7) and KBIG-FM (104.3).

Indie 103.1, which simulcasts from Newport Beach and Santa Monica under the tandem call letters KDLD and KDLE, has a relatively weak signal in the Los Angeles market. Still, the venture was seen as an attractive option that might steal some listeners from KROQ.

And although Indie's overall market ranking is modest, in the key 25- to 34-year-old demographic group it outdid KCBS-FM (Arrow 93.1) and KLOS-FM (95.5) during the latest ratings period, fall 2004.

The station has been a hub for L.A. punk and alternative-rock mavens and has prided itself on a ragged and adventurous vibe that seems more like that of a college station than a major market endeavor. Luminaries including Courtney Love and Dave Navarro have been at the microphone.

"People fall in love with the concept of the station," Pollack said, but he added that "in this era that kind of eclectic music mix is competing with offerings on the Internet and the music collections of people with their own iPods."

I won't believe it 'til it happens... but damn, this would suck if they ended indie 103. :(

And I'm REALLY diggin' Dicky Barrett's Mighty Morning Show... finally, something good in the morning to listen to.

But seriously everything on 103.1 never lasted that long.

Thank God...

Though, without Dickie from the Bosstones, I don't know if I'll have the energy/drive to get out of bed to turn off my clock radio anymore...

His awfulness is the only thing that can get me out of bed some mornings...

Between all the morning shows in LA:
98.7- Jamie & Danny, ugh Jamie's voice is annoying
Power 106- Big Boy, no thanks
The Beat- Steve Harvey, not interested.
KROQ- Kevin & Bean, sometimes I'll listen because they have funny segments
KCRW- NPR, don't like listening to talk radio in the AM.
Indie 103- Dicky Barrett. I like his voice. And his music selection ain't too shabby... can't complain here!

Seriously though, I think the station can do fine without Clear Channel selling their ads... the station definitely has built up their reputation over the past year so I'm sure that advertisers know where their market is at.

I agree. It shouldn't be a prob at this point. I hope they don't just disappear like Party Station did.

That party station deserved to go away. And I'm a HUGE fan of electronica music, but I hated what they played on there... Mars FM on the other hand....

There's been rumors about Indie's demise since Day 1. But it will be interesting to see what happens in the next month or so.

If they take away my Jonesey's Jukebox I'm gonna be pissed.

While the music industry and fans of modern rock have strongly embraced Entravision's KDLD/KDLE Los Angeles, Clear Channel is ending their joint sales agreement with the station, putting the future of Indie 103.1 in question.

Clear Channel Los Angeles RVP Roy Laughlin tells the Los Angeles Times that they'll end their partnership on April 1. The JSA gives Clear Channel nine stations, one more than allowed, now that the Federal Communications Commission has ruled that JSAs are attributable to a station's local ownership count.

"Our lawyers have told us that we have to do this, Laughlin told the Times. "The audience and advertisers will see no disruption, that is my hope."

Indie 103.1's eclectic classic modern format made it a favorite of musicians, with former Sex Pistol Steve Jones and Mighty Mighty Bosstones frontman Dickie Barrett among those serving as on-air hosts. Other artists, including Dave Navarro and Courtney Love have stopped by the station as well. Among the acts the station has championed are Modest Mouse and Franz Ferdinand. Indie has garnered coverage in Blender and Rolling Stone, which called them "America's coolest commercial station."

Times report, as well as industry rumors, regarding the end of the station's Join Sales Agreement with Clear Channel. Already there is talk that both Emmis and Radio One are already in LMA and/or JSA discussions with Entravision. Here is Steele's letter: "Everyone: As you all know I was on record and confirmed with all of you and our clients that Entravision had a solid Joint Sales Agreement with Clear Channel that would be uninterrupted through September of 2006. What I didn't know, and attorneys apologized for not informing us of sooner, is that new FCC laws are forcing that agreement to end as of March 31st, 2005. What this means for Indie is this: Entravision will take back all sales of Indie airtime on April 1st. Entravision is moving forward to continue operating the station AS IT IS. That means no format change. Nothing will change as far as any of your shows go. Everyones agreements are still in place. All this means that Indie will no longer have ANY affiliation with Clear Channel. I'm sure you are all going to be hearing everything on the street from "Indie is going spanish" or "dance music is coming back" , etc. NOT TRUE. We are going to continue being the most creative, musically exciting thing on the radio. Don't believe the bullshit on the streets. Yes and No on him being a 'radio guy'. The radio station was a gift after all from his very rich parents. He became a 'radio guy' when the station was bought for him.

Note to self: aquire rich parents who like tyo give me gifts.

Parents: "Honey, what do you most want for your birthday?"
Son: "Hmmm...I've always wanted my own radio station."
Parents: "Okay."

I've forgotten who his parents are, but they're supposedly big cheeses in the entertainment industry. And Michael has basically acquired a lot of friends (ie, Steve Jones, etc) via his family and invited them to work at his little hobby of a radio station. Life ain't too shabby for him, I guess.
