Of COURSE it's unconstitutional. It's an issue of civil rights and government getting involved in what should be a religious issue.

I fully expect that this will go to the Supreme Court and that they will overturn this, as well. States rights do NOT supercede an individual's civil rights, motherfuckers.

my old constitutional law professor is probably spending 2 hours today using this as another of the very few examples of where the courts use a beefed up version of the good ol' rational basis test.

is there really no possible non-discriminatory rational basis for this law? i am sure there are a couple hundred million mouth breathers who would disagree with the 9th circuit that there isn't.

of course i'm a commie and usually agree with the 9th circuit (who are mainly commies too)

Thanks for the good wishes. My partner and I have been together 18 years (we bonded on comparing the relative merits of telecaster and stratocaster guitar tones in British rock - although there remains the tension of his Deadhead inclinations and stoner-metal pretense vs. my psyche-electronic, folk-rock, Euro jazz penchants). We had an illegal pagan marriage ceremony in Big Sur many years ago... and in the window of opportunity in 2008 before Prop 8 got legally married in 2008. Although as a child I would never have conceived the possibility, now it seems so normal I am baffled as to why anyone would care about our marriage.

And given my voracious appetite for extreme experiences fueled by chemicals, any doomsday lid would never have lasted through a summer...

By the way, had a great conversation with John Waters at some publication party at the Variety Arts Theater downtown LA in the late 80's. He was very polite and very smart. I doubt anything about him would indicate an inclination to a pilgrimage of any sort ... not even to Kitsch Icons, which straight people always want fairies like John to worship. Vicarious cheap thrills for the straight person... yawn.
