 Post subject: Smart people who know about taxes... read me...

My ex has back taxes up the arse (well, just $3-5K) and has asked for my social security number so he can file his taxes and pay the IRS. I always filed "married filing separately" because I had a proper tax-taking paycheck and he didn't. Am I responsible for his debt because we were married when he neglected to pay the taxes?

I'm guessing not. I paid taxes on what I earned and also on our property (wasn't in his name), so I feel like i'm in the clear, but who knows when the IRS gets involved.

Anyone?

I wouldn't give him your Social Security Number, though I doubt you are responsible for his tax debt if the IRS hasn't filed a claim against both of you. The only time you'd be responsible for his debt would be if you were both co-signers on a loan or jointly held a credit card.

not sure about taxes at all but most states have Family Expense statutes where certain debts incurred by one spouse can be collected from either, even after divorce. I do not believe taxes are included in those, but if he has any other debt you are worried about I would look at your state's statute.
