Apparently he is suing Coldplay because they stole "substantial original portions" of his 2004 instrumental "If I Could Fly" in their song "Viva La Vida".

I haven't heard Joe's song.

Although, during all my research on guitars, amps, effects pedals, etc, I've been completely amazed at how much shit bears his name and how much he is revered in some guitar geek circles. It's baffling.

Wasn't there some no name band that accused them of stealing "original portions" of their song for Coldplay's "Viva la vida" also? I guess that just goes to show when you write a song with 2 chords in it with a moderately simple vocal line, it's gonna sound like some other shit. haha

1. Same key and tempo really makes it a lot closer. I mean, the chord progression has been used a billion times, but to be dead-on on the key and tempo is a little more of a coincidence.
2. You notice the quick "ROFL" that flashes across Chris Martin about 10 seconds in?
3. Anyone ever seen Satriani, Andre Agassi and Paul Shafer in the same place at one time?

No way they can do that. If he was some obscure artist and the song had never had any sort of distribution, maybe. I'd say they're somewhat hosed on this one.

the question isn't whether the song is well-known, it's whether coldplay had access to it. if they did, and if the two are "substantially similar," then copying is inferred and there's infringement.

Incorrect. The original theme was written by none other than JEFF "SKUNK" BAXTER!

The theme that everyone knows now with the hand claps was written by some dude named John Davis in the 2nd season.
