 Post subject: I've been stealing CDs from Tower.

Every time I go into Tower Records, I find these CDs that have bonus promo CDs strapped to them w/ a rubber band. I slip off the rubber band, and put it onto a CD I'm buying, along with the bonus disc.

The cashier never knows, and no one has said anything. I don't even try to hide it. Does this mean I want to get caught?

The discs don't have the strip that sets off the alarm, if you were wondering.

but really it was gonna be free anyway so is it stealing? it's more like buying three shirts in a pack and mixing and matching to get the colours you want.

I'm technically not allowed to enter a Tower Records for the rest of my life. Got caught stealing a Squeeze CD in high school. Best part? I was with my dad.

Technically, you're not stealing anything. The "get one free discs "are a strong suggestion that you should buy the record they come with, but completely unenforceable as theft if you were to walk in and just carry them out of the store.

How does Balls know this you ask? My senior year of college I worked in a liquor store, and I assume you are familiar with the gift packages that you will periodically see which may have a 2 liter soda bottle with a bittle of booze. If you look closely, you see the gift package is exactly the same price as the bottle on its own. The soda is free.

So, I'm working my shift by myself and some guy comes in and with impunity tears open a gift package of Crown & Coke & starts to just walk out with the coke. I yell at him and he doesn't even look back, so I hop the counter & tackle him from behind thinking I'm a hero. He produces an ID badge from the state liquor commission and tells me it was a test to see if I would attempt to CHARGE him for a free item. Since I never asked for money, just assaulted him I passed their test.

At many smaller stores, they will keep the bonus discs behind the counter and just give them to you when you buy the record they were intended to go with but I assume Tower really doesn't care.

I don't think this is "stealing". Here's how I'd construct my defense, were I your lawyer:

The intent of the cd, clearly marked "bonus promo", is either to entice customers to purchase a cd, or to advertise the music contained on the sampler.

In either case, Tower has received consideration. As long as my client has purchased an underlying CD, Tower has benefitted.

The only scenario in which there may be a transgression is if the "bonus promo" is issued by a label to encourage sales of that label's product and my client has attached to promo cd to a product of a different label. However, in this case, it is an issue between my client and the label, not Tower.

I hereby motion to dismiss the charges.

Incidentally, similar law applies to the money in wishing wells/mall fountains.

A friend of mine in high school was busted by mall security for taking quarters out of the mall fountain (he couldn't be bothered with the smaller denominations). The associated complaint was dismissed, the reasoning being that the people who had thrown the money in the fountain had relinquished all claim to it, and that said coins were no different from coins dropped on the floor. Absent signage to indicate that the fountain was a special recepticle and coins contained therein were the property of the mall, the money was free for the taking.

Btw, I love the huge rubber bands that Tower puts around those CDs with the freebies. They're thick and yellow, similar to those Lance Armstrong wristbands everyone is using. I wore my "life" band on my flight to Scotland -- it reads "FREE WITH PURCHASE". No one purchased me, though.
