I've gotta weigh in on this one. If I were the prosecutor, I would look at whatever misdemeanor statute is on the books. In Missouri it reads:

A person commits the crime of stealing if he or she appropriates property or services of another with the purpose to deprive him or her thereof, either without his or her consent or by means of deceit or coercion.

The promo CD, even though it's free with the purchase of the other disc, is the property of the record store. They give you permission to take it out of the store when you buy the CD it's originally attached to. When you attach it to another CD, you don't have their permission to leave with it. It's stealing.

Unless.... you could successfully argue that they have given you their implied consent when they checked you out with the CD. But you say they never notice.

BTW I'm a prosecutor.

Nevermind the moral (!) argument that if you define your own actions as "stealing" then it's probably not the right thing to do.
