 Post subject: graphic design ethics question

if i do a design and the client doesn't use it, can i use the same design again for another client?

it works so perfectly.

I personally don't see why not. It's still your design, so you should be able to do whatever you want with it, esp. since the last client turned it down.

I agree, unless they paid for it, and own the design but don't use it, I say its fair game. Then when yr new client gains superstar status you can say sure, I can make you another like it, and charge them quadruple the price.

Unless it is a work for hire agreement and/or the rights are transferred specifically and in writing, the designer retains all copyright and usage rights even after being paid. The client only retains a license, which can be as specific as the designer chooses with regard to usage, geography and time period.

I say go for it. It's great when things work out that well.

particularly in a case like this when i was so upset that they didn't use this idea and went with the generic boring one.
