haha. I mean, I suppose, in retrospect, I believe that's the case. I was not aware of the basic human right of marriage. If it is a right, then I am willing to be shown that.

It's been a few years since I took constitutional law, but I'd be surprised if the right to marry isn't a fundamental right under the Constitution.

Fundamental right to marry has been recognized by the SCOTUS

Right to Marry is spelled out in Loving, but other cases have said the Government can regulate it (Zablocki). Also, some have read Loving in a more constrained way and says it stands for the proposition that there is a fundamental right to marry someone of another race.

yeah, what he said. it's definitely not a "privilege" in the same sense as a drivers license or even voting. both of those can get taken away if you break the law. but even a prisoner serving time for a horrible felony still has the right to get married. i'm not aware of any circumstances where two unattached adults of the opposite sex can legally be denied the right to marry.

all "fundamental rights" can be restricted; its just that a state has to pass a higher level of scrutiny by the Court when someone challenges those restrictions.
