to settle a dispute- if a person (ex-boyfriend) leaves something at another person's (old girlfriend's) house, makes no attempt to pick it up or get it for almost a year, and then all of a sudden wants it immediately and threatens legal action, do they have any kind of case? the item in question is an elvis costello concert t-shirt.

wow i went through this same shit over a camera that i took a picture of my dick with and a bunk cd player. i found that telling the guy to go fuck himself works pretty well.

we got a doctor and an editor and some kind of dork, so i'd say that we're pretty close. also, we have extensive experience with the legal system that's probably going to top whatever lawyer you get to take te great "t shirt swiping" case. Might want to see what Encyclopedia Brown is up to.

Well, "adverse possession" (essentially squatting on somebody's land until it becomes yours), which is the nearest legal theory to "when an ex leaves something at my house and doesn't ask for it back it becomes mine," varies across jurisdictions but usually takes several years.

To crack's question, if you just wanted to get rid of the shirt, you probably could do so after making a good faith effort to return it, but that's just a guess. It would be entirely up to the court.

First, this is not legal advice.

I wouldn't pay for postage if he left it with no expectation or promise from you that you'd send it. I doubt he'll sue you for the cost of postage. It's a pain in the ass to sue someone. It costs time and money, even in small claims court. I doubt he'd sue you for the shirt, either. Especially if you're willing to let him pick it up.


Can a small claims court grant equitable relief? I'd gues no, but I guess it could vary by jurisdiction.
