 Post subject: NMR: inquiry about trespassing laws?

this week i had an art giveaway
3 free paintings
with a small catch

i put the art in very hard to get to
areas around town
and then i posted the locations
in my myspace blog (this entry only visible to friends)

within 30 hours all the paintings had been taken

it was a very thrilling project

im wondering
...
what kind of trouble i could get in
if i continue to do this sort of thing

as far as trespassing
im kind of under the impression
that i have to be caught
and asked to leave
and i have to refuse to leave
to actually get in trouble
unless its a repeat deal

or
could i get a littering fine?

anyone know about this stuff?

Are you talking about private locations where you're not supposed to go? Or just hiding things in public areas or shops without the knowledge of the proprietor?

well... the only one with a "no trespass" sign was the dock

but the other two... were just areas that people obviously shouldnt be

This is my understanding of the law, but it is not legal advice, and trespass laws may change from state to state.

1. Trespassing is usually both a violation of a criminal statute and a private tort, meaning that the owners could report the trespasser to the police or sue in civil court (although in the latter case they would have to show harm--there isn't likely to be any unless one of your adventurers hurts himself, then sues the proprietor, who in turn sues you for indemnifications).

2. Your disclaimer is probably not sufficient to alter your liability. You are encouraging people to do illegal things, and if they get hurt doing them, or cause damage to private property, I doubt a court would be sympathetic merely because you tried to shield yourself.

3. I still wouldn't worry too much.

yea
i didnt think the disclaimer would save me
but
mainly out of humor and
worry that people would go about this drunk
its one hell of a climb

is there a disclaimer that would protect me?

No, you can't really disclaim criminal liability. Particularly when you've done something criminal and are baldly encouraging others to do the same.

I think the only person that could get in trouble (and you're probably looking at a small fine at most- as long as you don't somehow damage the property) is whomever is actually caught trespassing. I don't think anyone can shift any sort of responsibility/ liability to you for encouraging them to trespass. Yeah, someone could say that you trespassed when you put your art there, but how is anyone gonna prove that you actually did it?

(not legal advice).

I think this is pretty cool. Kudos.

i think you're right
encouraging someone else to break the law
doesnt make me the responsible party
if they choose to do so

they still have to decide to do what they know they shouldnt

unfortunately
there was a little damage done at the mill because someone didnt fallow instructions
they cut upen a cagedoor
to climb a ladder (only to realize they climbed the wrong ladder)
but
shit
i pointed them directly to the right one
