I'm an eBay novice so I'm not sure what to do here. Anyway I 'bought' some t-shirts from a seller on eBay and paid by cheque.

About a week or so later the cheque was cashed and I was expecting my t-shirts to arrive shortly. But no. A month passed. I got in touch with the seller again and they claimed that I hadn't sent my address details with the cheque. This was true because I'd just assumed the seller would be forwarded address details through eBay like Amazon does (it was my first ever eBay purchase). Still the fact that they didn't have my address details (so they claim anyway) didn't stop them cashing the cheque and making no attempt to contact me.

So I gave them my address details and expected my t-shirts to arrive shortly. But no. A month passed. I got in touch with the seller again and they claimed that they had sent them out and it was very unusual for anything to get lost in the mail but they would send out a second parcel since I hadn't got the first one.

These things happen I supposed but since they had promised to send out a second parcel ASAP, I expected my t-shirts to arrive shortly. But no. A month(well nearly) passed. I got in touch with the seller again and this time they claimed that they had "forgotten" to send the second parcel and current claim it is "on its way", this being today the 20th April when the original order was made on the 4th February.

Quite frankly, I'm not holding my breath for these t-shirts. I told them I'd give them till the end of the month to get my merchandise.

Basically what I'd like to know is what do you do in a situation like this where a seller on eBay doesn't deliver the goods promised. Leaving a negative comment doesn't seem good enough when I'm out of pocket. Is it a police matter? Does eBay have some sort of process to deal with this?

In the US at least there is a resolution process. You're supposed to try to work out an accomodation with the seller first, but if you don't you can file a dispute with ebay. Ebay then investigates and if they find in your favor, they give you a refund. I think i've always gotten it when I've sought it. There is a timeframe in which they let you file the dispute which expires (don't hold me to this) about 90 days after the date of purchase.

I'd look it up and try to be more exact but it might not be the same in the UK anyway...poke around the customer service pages and FAQ pages Darrin and you should find your answers.

I think it might be 45 days to file a complaint, but I also am not positive. Basically all you can do if you missed that deadline is leave a negative. Also, since you have their address feel free to sign them up for magazine subscriptions or whatever you like.

Don't you have your address on checks in the uk? (apparently not!)

Leave a negative feedback, they'll probably do the same to you. Other sellers might be unwilling to sell to you if you've got 100% negative ratings.

I'd ask for a partial refund once the t-shirts arrive.

it's the seller's responsibility to follow up with missing information. They should have requested your address the day they received the check.

Beware, they will leave you negative feedback in retaliation unless they already left you positive. Wait until the last possible day to leave negative feedback. I think it's the 90th day or something.
